The contract between YPF and Chevron: a form confused in the relationship between the State and the market

Abstract

This article aims to understand how state and market are articulated in the contract signed between YPF and Chevron on 16 July 2013, whose purpose is exploit of the Loma Campana concession (Neuquén). In order to meet this objective, we provide an interpretation of the state's role in the contract, as well as the form of joint between a state-controlled company and a transnational company. Public and official documentation is used, including the contract itself, which allows us to meet the legal and economic implications thereof. We conclude that the contract is assembling a network of companies, commercial contracts and legal mechanisms to decouple Chevron from any responsibility about socio-environmental problems, as well as to construct a safe way to channel the injection of capital. The signing of the agreement is framed in a context in which government should ensure the expanded reproduction of capital because it was threatened by shortage of foreign exchange. The form of intervention takes the form of State enterprise corporatized through YPF.
